What are the costs of the Homologation Assistance Service (HAS)?
- The costs of the HAS are established in accordance with Article 1 of the Regulation respecting legal aid. They amount to $647, including $470 in fees and $177 in court costs..
- This amount will be shared equally by each party, so each will have to pay $323,50.
- A person who is financially eligible for free legal aid will not pay anything, while one who is eligible under the contributory scheme will pay the lesser of the contribution or the cost of the HAS ($323,50).
- If the parties can no longer agree once in the presence of the lawyer, legal aid is then withdrawn. A partial fee of $117,50 is paid to the lawyer and the remaining amount paid by the parties ($529,50) is refunded to them.
- If the special clerk refuses to homologate the agreement, it is returned to the lawyer for modification. If the parties refuse to make the suggested changes, the lawyer may cease to represent them and legal aid is withdrawn. The lawyer then receives a partial fee of $235 and an amount of $235 is refunded to the parties (the $177 court stamp having already been paid).
